Terms of Service
Last updated: January 2026
These terms are an agreement between you, or the company you act for ("Customer", "you"), and Fortune Bit Solutions Sdn. Bhd. (201801038348 (1300379-U)) ("Fortune Bit", "we") for the use of eSigner. By creating an account or using eSigner, you accept these terms. If you accept for a company, you confirm you have authority to bind it.
1. The service
eSigner lets you upload documents, add signature, stamp and form fields, send them to others to sign electronically, and keep the signed documents with an audit trail. Features depend on your plan, as listed on our pricing page. We may improve or change features, but will not materially reduce the core features of a paid plan during a paid period.
2. Accounts
- You must give accurate information and be at least 18.
- You are responsible for everything done under your account and for keeping login details safe. Tell us at once at support@fortunebit.my if you suspect misuse.
- Account owners control who in their team can access documents.
3. Plans, fees and payment
- Free plan: limited users and documents, provided as is, and may be changed or withdrawn with notice.
- Starter and Business: billed monthly or annually in advance, in Ringgit Malaysia. Prices exclude SST, which is added where it applies.
- Corporate: fees, services and terms are set out in a separate order form or agreement, which takes priority over these terms where they differ.
- Limits: if you go over your plan's document limit, you can buy top-up packs or upgrade. Extra users are charged per month.
- Renewal: paid plans renew automatically for the same period unless cancelled before the renewal date.
- Refunds: fees already paid are not refundable, except where the law requires or we end the service without cause.
- Late payment: we may suspend paid features if fees are more than 14 days overdue, after giving notice.
- Price changes: we will give at least 30 days' notice, effective from your next renewal.
4. Electronic signatures
- eSigner provides electronic signatures, which are recognised under the Electronic Commerce Act 2006. It does not currently provide digital signatures under the Digital Signature Act 1997.
- You are responsible for deciding whether an electronic signature is suitable for each document. Some documents, such as wills, powers of attorney, trusts, negotiable instruments and statutory declarations, may need other formalities or may not be signed electronically. Documents that need stamp duty may need separate steps with LHDN.
- You are responsible for checking the identity of the people you send documents to. Optional checks, such as account login, two-factor authentication or passkeys, help but do not guarantee identity.
- Fortune Bit is not a party to the documents you sign and is not responsible for their content or for whether they are enforceable.
5. Your content
- You keep all rights in the documents and data you upload ("Customer Content"). You give us permission to host, process and transmit it only to provide and secure the service.
- You confirm you have the right to upload Customer Content and to share signers' personal data with us for signing.
- For personal data in Customer Content, you are the data user and we act as your data processor. We will process it only on your instructions, keep it secure and help you respond to data subject requests, as set out in our Privacy Policy.
- You can export or delete your documents at any time while your account is active.
6. Acceptable use
You must not use eSigner to:
- break any law, or forge or misrepresent signatures or identities;
- send spam, malware or fraudulent documents;
- upload content that infringes others' rights or is unlawful;
- try to break, overload, copy or reverse-engineer the service, or get around plan limits.
We may suspend accounts that break these rules, with notice where practical.
7. Support and availability
- Support is available Monday to Friday, 9am to 6pm Malaysia time, excluding public holidays. We aim to reply within one business day.
- We aim to keep eSigner available at all times, apart from planned maintenance, which we will try to schedule outside business hours and announce in advance.
- Uptime commitments and service credits apply only where a Corporate agreement sets them out.
8. Our intellectual property
The eSigner software, brand and website belong to Fortune Bit or its licensors. These terms give you a right to use the service during your subscription, not ownership of it.
9. Confidentiality
Each party will keep the other's non-public information confidential and use it only for this agreement. This does not cover information that is public, already known, or that must be disclosed by law.
10. Warranties and liability
- We will provide the service with reasonable skill and care. Apart from that, and to the extent the law allows, the service is provided "as is" without other warranties.
- Neither party is liable for indirect or consequential loss, including loss of profit, business or data, to the extent the law allows.
- Our total liability in any 12-month period is limited to the fees you paid us in the 12 months before the claim. For the Free plan, it is limited to RM100.
- Nothing in these terms limits liability that cannot be limited by law.
11. Ending the agreement
- You can cancel at any time in your account settings; access continues to the end of the paid period.
- We can end or suspend your account if you seriously breach these terms and do not fix it within 14 days of notice, or at once for fraud or illegal use.
- After the account ends, you have 30 days to export your documents, after which we delete them and their audit trails. Your account data is deleted 90 days after closing, as described in our Privacy Policy. You are responsible for keeping your own copies of signed documents for as long as you may need them, for example as evidence in a dispute.
12. Changes to these terms
We may update these terms. We will give at least 30 days' notice of material changes by email or in the app. Continuing to use eSigner after that means you accept the new terms.
13. Governing law
These terms are governed by the laws of Malaysia. Both parties agree to the jurisdiction of the courts of Malaysia.
